These Terms apply to use of this website and general project inquiries with Shiv's Web Studio. A separate written proposal, invoice, or agreement may apply to paid client work.

Demo websites and examples

Website concepts, demo businesses, sample content, images, names, testimonials, and examples shown on this website may be fictional or used for demonstration purposes. They are meant to show possible design directions and do not guarantee identical results for every project.

Project inquiries and proposals

Submitting a form or sending an email does not create a client relationship by itself. A project begins only when scope, pricing, timeline, deliverables, and payment terms are accepted in writing.

Pricing shown on the website is a starting point. Final pricing may change based on pages, content needs, features, timeline, revisions, integrations, and support requirements.

Client responsibilities

Clients are expected to provide accurate business details, service information, brand assets, logos, photos, account access, domain access, and feedback needed to complete the project.

Clients are responsible for making sure provided text, images, logos, trademarks, reviews, and other materials are accurate and that they have the right to use them.

Account access and sensitive information

Clients should avoid sending passwords, payment details, private keys, or sensitive login information through standard contact forms or unsecured email. When account access is needed, a safer sharing method should be used when available.

Payments, scope, and revisions

Payment schedules, deposits, milestones, revision rounds, and delivery dates will be defined in the project proposal, invoice, or written agreement.

Requests outside the agreed scope may require additional pricing or timeline changes. Delays in content, approvals, access, or feedback may also affect the project timeline.

Timelines

Project timelines are estimates unless a written agreement states otherwise. Timelines may change based on content readiness, feedback speed, revision requests, access to accounts, third-party tools, and project scope changes.

Client review and approvals

Clients are responsible for reviewing and approving project work, content, spelling, contact information, links, images, services, pricing, business details, and final website information before launch. Shiv's Web Studio will make reasonable efforts to test and review work, but clients are expected to confirm that business information is accurate.

Third-party services

Projects may involve third-party services such as domain registrars, hosting platforms, deployment tools, email providers, booking systems, analytics, maps, fonts, plugins, or stock media.

Clients are responsible for third-party fees unless a written project scope says otherwise. Shiv's Web Studio can help connect and configure tools, but third-party services are governed by their own terms, privacy policies, uptime, pricing, and support rules.

Ownership and portfolio use

After final payment, clients receive ownership of the final custom website content and deliverables created specifically for them, except for third-party tools, licensed assets, open-source software, reusable code, templates, processes, and pre-existing materials.

Unless a client requests otherwise in writing, Shiv's Web Studio may reference completed work in a portfolio, case study, proposal, or marketing material.

No guarantees

Shiv's Web Studio aims to build clear, professional, mobile-friendly websites, but does not guarantee specific search rankings, traffic levels, revenue, lead volume, conversion rates, or business results.

Website performance can be affected by market demand, business reputation, content quality, advertising, competition, third-party platforms, and client follow-through.

Limitation of liability

To the fullest extent allowed by law, Shiv's Web Studio is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost data, or business interruption.

Any liability related to a paid project will be limited to the amount paid for the specific service giving rise to the claim, unless a separate written agreement says otherwise.

Cancellations and refunds

Project deposits may be non-refundable once work has begun, unless a written agreement says otherwise. If a project is paused, delayed, or canceled, any amount owed may depend on the work already completed, time spent, third-party costs, and the terms of the accepted proposal, invoice, or written agreement.

Refunds, cancellations, pauses, and termination details should be handled in the written project agreement or invoice terms for that specific project.

Changes and termination

Shiv's Web Studio may update these Terms as services, tools, or business needs change. Continued use of the website after changes means you accept the updated Terms.
